Scotland Football TV - Service terms and conditions
These terms and conditions (“Terms and Conditions”) apply to your use of the ScotlandFootballTV Service (“the Service”) to access Scottish Football Association related content (“Content”). By viewing or accessing the Content via the Service, you agree to these Terms and Conditions of use. IMG (as defined below), ON BEHALF OF THE SFA (as defined below) RESERVE THE RIGHT, AT ANY TIME, TO MODIFY THESE TERMS AND CONDITIONS BY POSTING A REVISED VERSION ON THE www.ScotlandFootballTV.com Website AT http://www.scotlandfootballtv.com/terms-and-conditions. YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD (AND AGREED TO BE BOUND BY) THESE TERMS AND CONDITIONS NOW AND EVERY TIME YOU USE THE SERVICE. BY CONTINUING TO USE THE SERVICE YOU ACCEPT THE REVISED VERSION.

1. The Service
The ScotlandFootballTV Service is provided to you by IMG Media Limited (Company No: 4459066, registered office: McCormack House, Burlington Lane, London, W4 2TH, United Kingdom) (“IMG” or “we”) and its subcontractors, on behalf of Scottish Footbal Association (Company No: TBC) (“the Club”).
The Content will be made available for viewing by you once your payment has been authorised subject to these Terms and Conditions. Until your payment is authorised, we may decline to supply the Content to you. No contract will be entered into between you and IMG unless and until you make payment for the Service.
You are responsible for providing all equipment and software necessary for you to view and access the Content. The list of components you require is set here. We will not be responsible to you if your equipment or software is not compatible with the Content.
2. Usage
The Content is the property of Scottish Football Association or its licensors and is protected by copyright law. You may use the Content only for your personal and non-commercial purposes.
Any copying, reproduction, lending or hiring, public performance, broadcasting or any other form of distribution of the Content (including peer to peer transfers, and posting on other websites) other than in accordance with these terms and conditions is prohibited and will constitute a copyright infringement.
3. Defective Content
If you are unable to view the Content please contact our helpdesk by using the contact details below. Where this is due to our default, we will replace the Content or provide a refund at our discretion. We shall have no responsibility to reimburse you, whether by refund or credit, in the event you are dissatisfied with any particular Content (e.g., an error by you as to which event you intended to watch) the quality of the Content (e.g., the quality of the video or audio), the delivery of the Content to you (e.g., the speed of your connection to the Service) or any other matters outside IMG’s control.
4. Material in the Content
You agree that we shall have no liability to you for any Content, including but not limited to any that may be found to be offensive or otherwise objectionable.
5. Prices and Payment
You must pay the subscription charge (the "Charge") applicable to the time period (the "Service Period") for which you have subscribed, according to the charges notified to you at the time of your registration.
The Charge will be automatically billed to the credit card number provided in your registration form. PayPal will notify you by email that your card has been debited and that you are a registered subscriber. The dispatch of that email message constitutes our acceptance of your subscription application. We accept no responsibility for you not actually receiving the email for reasons beyond our control.
Please refer to the SFA TV Frequently Asked Questions section on the Website (“FAQ’s”) for details of our refunds policy. The FAQ’s form part of these terms and conditions and can be viewed here. To the extent there is any conflict between the terms set out in the FAQ’s and these Terms and Conditions, these Terms and Conditions shall apply.
Our prices only cover access to the Service. Telephone line and other communications or access costs may be charged to you separately by your ISP or relevant service provider. All our prices are inclusive of applicable value added taxes at the rates in force from time to time. Except in the case of manifest error, the prices payable for the Service that you order are as set out in the Website at the time at which you place your order. If, by mistake, we have under-priced the Service or an item of Content, we will not be liable to supply the Service or that Content to you at the stated price.
Payment services are provided by PayPal and are subject to their Terms and Conditions which can be viewed here.
6. Availability of the Service
We reserve the right to modify, suspend or discontinue the Service and the Content provided to you under these Terms and Conditions (or any part of it) without notice to you and shall not be liable to you if we exercise these rights. You acknowledge that you may no longer be able to view the Content if we discontinue this Service and you agree that we shall have no liability to you in that event. Where commercially practicable, we will try to give you reasonable notice of any discontinuation of the Service.
We may prevent your access to the Service and/or Content if you breach these terms and conditions.
7. Liability
The Service and the Content provided under these terms and conditions is provided on an "AS IS" and "AS AVAILABLE" basis and IMG makes no guarantees that the Service or Content will be available, uninterrupted or error free, or that defects will be corrected, or that the Service, the Content or the server that makes it available are free of viruses or bugs.
Our liability to you in connection with any order will not exceed the total price charged for the relevant Content or Service Period.
In no event will IMG or our affiliates be liable for indirect or consequential damages, loss of use of the Content or the Service provided under these terms and conditions or loss of data or profits, whether in action of contract, negligence or other action arising out of or in connection with the use of the Service or the Content. These exclusions do not apply to death or personal injury caused by IMG’s negligence and only apply to the extent permitted by law. This does not affect your statutory rights.
We will not be liable to you for any inability to view the Content or any other loss arising due to any reason beyond our reasonable control, including but not limited to the postponement, delay or abandonment of any relevant match.
8. Use of Your Information
IMG and/SFA will use the information you provide in the registration process primarily in order to provide the Service to you and to communicate with you. In order to do so IMG and/or SFA may pass your information to third parties involved in the delivery of the Service, some of whom are based outside the European Economic Area. We may also need to store or transfer your personal information in or to countries outside the European Economic Area, some of which do not protect privacy rights as extensively as in the United Kingdom. This will include holding your personal data on servers which are located in the US.
IMG and/or the Club may also use your personal data to create and analyse demographic profiles of users of the Service. Any such research may be used by IMG and/or SFA for any purposes provided that it does not identify you personally.

IMG agrees to treat your personal data in compliance with all applicable data protection legislation.
9. Indemnity
You agree to fully indemnify IMG, its affiliates and subcontractors and SFA from and against all claims, liability, damages, costs and expenses whatsoever, including legal fees, arising out of any breach of these Terms and Conditions by you (or any other user whom you permit to use the Service with your username) and any other liabilities arising out of your or their use of the Service.
10. General
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
If any of these terms and conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
Nothing in these Terms and Conditions is intended to operate (nor will it operate) to affect your statutory rights.
You agree that we may assign or transfer all or any of our rights and/or obligations under these Terms and Conditions to any third party.

To the extent these Terms and Conditions conflict with those Website Terms and Conditions, these Terms and Conditions will take priority.
